Terms of service
These terms apply to website design, development and care services provided by , trading as Maval Digital ("we", "us"), to our clients ("you"). They apply to business clients and to consumers. Where mandatory consumer protection law gives consumers more rights, those rights apply.
1. Proposals and contracts
After a free introductory call, we send you a written proposal with the scope, fixed price and timeline. A proposal is valid for 30 days. The contract is concluded when you accept the proposal in writing (email is enough) and, where agreed, pay the first instalment. The proposal and these terms together form the contract. If they conflict, the proposal takes priority.
2. Prices and payment
Prices on our website are starting prices. Your price is the fixed price in the proposal. All prices are in euros.
Unless the proposal says otherwise, you pay either 50% before work starts and 50% before launch, or three equal instalments: before work starts, after you approve the design, and before launch. Invoices are due within 8 days. If a payment is late, we may pause work and charge statutory default interest under Croatian law.
3. Your part
You provide the text, images, logos and other material we need, and you confirm you have the right to use them. Where we prepare privacy, cookie, legal notice or terms-of-sale pages, they are templates filled in with your details. We don't give legal advice: you are responsible for checking these texts, ideally with a lawyer, before launch. You give feedback within the agreed time. If a project is paused at your request or waiting on you for more than 30 days, we may reschedule it and invoice the work done so far.
4. Revisions and extra work
Each package includes the number of revision rounds stated in the proposal. Changes beyond that, or work outside the agreed scope, are quoted in advance or charged at per hour, always with your approval first.
5. Timelines
Timelines are estimates and depend on receiving your material and feedback on time. We let you know straight away if a date is at risk.
6. Domains, hosting and other services
Your domain, hosting and any paid services (payment providers, booking tools, email) are registered in your name and paid by you directly. Their own terms apply. We aren't responsible for their outages or price changes, but we'll help you choose reliable options.
7. Ownership
Once you've paid in full, you own the finished website and the design and content made specifically for you. We keep the rights to our general tools, code components and know-how, and give you a permanent, free licence to use them as part of your website. Third-party fonts, images and plugins are covered by their own licences. We may show the finished website in our portfolio unless you ask us not to.
8. Launch and fixes
We test your website on current versions of the major browsers before launch. We fix any defect you report within 30 days of launch at no charge. Statutory warranty rights for consumers are not affected.
9. Care plan
The care plan is billed monthly in advance and includes updates and security checks, a monthly backup, regular checks that the site is online and up to one hour of changes. Unused hours don't carry over. Either side can cancel with 30 days' notice in writing.
10. Liability
We are liable without limit for damage caused intentionally or through gross negligence, and for injury to life, body or health. Otherwise, for business clients, our liability is limited to the fees paid for the project concerned, and we are not liable for indirect losses such as lost profit or lost data. Mandatory consumer rights are not affected.
11. Consumers: right of withdrawal
If you are a consumer and conclude the contract online or by email, you can withdraw within 14 days without giving a reason. Send a clear statement to [email protected]. If you ask us to start work during those 14 days, you pay for the work done until you withdraw. Once the service has been fully performed at your express request, and you have acknowledged that you would then lose the right of withdrawal, the right no longer applies.
12. Confidentiality
We keep your business information confidential and use it only to carry out the project.
13. Ending the contract
Either side can end the contract in writing if the other seriously breaches it and doesn't fix the breach within 14 days of being asked to. You pay for the work done up to that point.
14. Complaints, law and courts
Send complaints in writing to [email protected]. We reply within 15 days. Croatian law applies. For business clients, the competent court for our registered address decides disputes. Consumers can also bring a claim where they live and keep the protection of the mandatory law of their country.
15. Changes to these terms
The version of these terms in force when you accept your proposal applies to your project.
